Terms of Service Agreement
eden Distro LLC ("eden") fulfills its business objectives by providing various products and educational materials through online channels to our valued customers. These Terms of Service ("Terms") govern all interactions with eden (including but not limited to product purchases, educational material access, rewards program participation, etc.), including use of its website (www.edendistro.com) ("Services").
For United States and Canadian residents, accepting these Terms includes agreeing to waive all jury trial rights and resolve any Eden-related disputes through binding arbitration (detailed in the Dispute Resolution section below).
Account Management
Creating an eden account may be necessary for certain Services. You are responsible for maintaining your eden account and must ensure all provided information remains accurate, particularly your e-mail address. Account credentials must be kept confidential. eden maintains the right to deactivate any account, without refund, if unauthorized access or use of login credentials occurs.
Product Acknowledgement Statement
eden offers hemp-derived products including CBD and THCA items to individuals over 21 years of age. These products are understood to contain THC levels within federal legal limits and those of eden's primary business location. eden makes no representations regarding product legality in your specific state or territory. Customers bear sole responsibility for verifying the legal status of eden products in their jurisdiction. Furthermore, customers should seek medical advice before using any eden product. Physician consultation is recommended prior to hemp product use. eden's statements have not undergone FDA evaluation, and our products are not intended for medical diagnosis, treatment, cure, or disease prevention.
The use of any kind of hemp product does not guarantee you will pass a drug test, as hemp products contain trace amounts of naturally occurring THC. Use caution when using any hemp product. If failing a drug test is detrimental to you in any way, do not use hemp products, as there is a risk of failing a drug test. You are responsible for knowing the state laws and regulations in your area and ship-to address. Therefore, it is up to the consumer to determine the legalities in their area of products purchased on this website.
Do not use THCA products if pregnant or nursing. Consult your doctor before use, especially if you are using any prescription medications or have a medical condition. Discontinue use if unusual symptoms occur. All Eden products contain less than 0.3% Δ9 THC. Do not drive or operate any machinery while using THCA products. THCA may affect blood pressure, heart rate, and/or intraocular pressure. If you have any known or unknown heart, blood pressure, eye pressure, or similar/related issues, do not use THCA products unless recommended by a doctor.
eden does NOT sell or distribute ANY products that are in violation of the United States Controlled Substances Act (CSA). All products sold in our store location or online are derived from hemp and contain 0.3% or less delta9-THC. THCA is not approved by the FDA for the diagnosis, cure, mitigation, treatment, or prevention of any disease. Any statements made regarding any products sold by Eden have not been evaluated by the Food and Drug Administration. The efficacy of these products has not been confirmed by FDA-approved research. These products are not intended to diagnose, treat, cure, or prevent any disease. All information presented here is not meant as a substitute for or alternative to information from health care practitioners. Please consult your physician about potential interactions or other possible complications before using any product. We are restricted from making any claims about the efficacy of our specific THCA products to treat or cure any disease or medical conditions. Service Payment Terms
You agree to remit payment for any eden Services or products you choose to purchase, authorizing eden to process your debit/credit card or other payment methods for such fees. Refunds are provided solely at eden's discretion, based on individual case evaluation.
Intellectual Property Rights
The entirety of eden's digital presence and Services, encompassing its website, current and future applications, mobile platforms, and databases, constitute eden's exclusive property. Use of eden's name, trademarks, logos, domain names, marketing content, educational materials, or brand identifiers is prohibited. Any feedback or suggestions regarding eden or its Services are provided voluntarily, and eden retains unrestricted rights to utilize such input without obligation. When accessing eden's platforms or utilizing its Services or products, you agree not to copy, modify, create derivative works, reverse engineer, or decompile eden's Services or materials. Furthermore, you shall not utilize the Services to transmit modified, deceptive, or falsified source-identifying information (including impersonating Eden in electronic communications).
Age Restrictions
eden explicitly prohibits sales of products or Services to individuals under twenty-one years of age. Persons under twenty-one must refrain from using any Services or products.

General Provisions
By registering for, accessing, or using eden's Services, you acknowledge entering a legally binding agreement with Eden, encompassing these Terms and eden's Privacy Policy. Access to and use of eden's Services is prohibited without acceptance of these Terms and Privacy Policy. These Terms constitute the complete agreement between you and eden, superseding all prior oral or written agreements. Modifications to these Terms require written documentation published on eden's website. Invalid or unenforceable provisions shall be severed while maintaining all other Terms provisions. eden's non-enforcement of any Terms provision or failure to exercise rights hereunder shall not constitute waiver of subsequent breaches or defaults, nor waiver of any provisions, rights, or privileges.
Services and products are provided "as is" and "as available." eden provides no warranties regarding Service or product suitability, reliability, availability, timeliness, or security, and disclaims all warranties and conditions (express or implied), including implied warranties of merchantability, fitness for purpose, title, and non-infringement. eden makes no guarantees about specific results from Service use. Service utilization is at your sole risk.
You acknowledge that eden bears no liability for indirect, incidental, punitive, or consequential damages (including data loss, revenue loss, business opportunities, personal injury, or death), whether arising from contract, warranty, tort, product liability, or otherwise, resulting from Services or product use. eden's maximum liability to any party is limited to amounts paid to eden in the 12 months preceding any claim.
You agree to defend, indemnify, and hold harmless eden, its members, managers, suppliers, partners, and agents against third-party claims, losses, damages, or expenses (including reasonable legal fees) arising from your intentional or negligent actions. This indemnification obligation survives Term termination and Service discontinuation. No joint venture, partnership, employment, contractor, or agency relationship exists between parties.
Dispute Resolution and Class Action Waiver: North Carolina law governs your eden relationship and Service use. All disputes under these Terms shall be adjudicated in Wake County. All controversies or claims relating to these Terms or eden relationships must be settled through arbitration administered by NAM (National Arbitration and Mediation), before a single arbitrator in Wake County, North Carolina. This arbitration agreement is enforceable under the Federal Arbitration Act, 9 U.S.C. Sections 1, et. seq. No arbitration may proceed as a class action or representative action. Arbitration proceedings cannot be consolidated or joined. THE PARTIES AGREE TO INDIVIDUAL ARBITRATION AND WAIVE CLASS ACTION PARTICIPATION RIGHTS.
Term Modifications: eden may update these Terms as needed to reflect practice changes or clarifications. eden reserves the right to modify these Terms at its discretion. Material changes will be communicated via email to your account address or through website notification. Changes become effective upon posting unless otherwise specified. Continued Service use following modifications indicates acceptance of changes. Updated Terms supersede all previous versions.
